Artist Terms of Service

1. Platform Role

Art+Ist ("the Platform") provides technology services that enable artists ("Artists") to showcase and sell their artwork directly to collectors. Art+Ist acts solely as a technology intermediary and is not a party to any transaction between an Artist and a buyer. Art+Ist does not buy, sell, or take ownership of any artwork listed on the Platform.

2. Payment Processing

Payments are processed through Stripe Connect. By connecting a Stripe account to the Platform, you agree to Stripe's Connected Account Agreement. Art+Ist facilitates the connection between your Stripe account and the Platform but is not responsible for payment processing errors, delays, or failures caused by Stripe.

3. Artist Responsibility for Transactions

As an Artist on the Platform, you accept full and sole responsibility for:

• All sales transactions conducted through your connected Stripe account
• All payment disputes, chargebacks, and refund requests initiated by buyers
• Maintaining sufficient funds in your Stripe account to cover any reversals, refunds, or chargebacks
• Ensuring the accuracy of artwork descriptions, pricing, and availability
• Fulfilling all orders in a timely and satisfactory manner
• Compliance with all applicable consumer protection and distance selling regulations

4. Chargebacks and Disputes

You acknowledge that Art+Ist, as a Stripe Connect platform, may be held liable by Stripe for negative balances arising from disputes or chargebacks on connected accounts. By using the Platform's payment features, you agree to indemnify and hold harmless Art+Ist against any losses, costs, or fees incurred as a direct result of disputes or chargebacks on your Stripe account. Art+Ist reserves the right to recover such costs from you directly.

5. Platform Fees

Art+Ist charges a platform fee on each sale processed through the Platform. Current fee rates are displayed at the point of sale and may be updated with reasonable notice. Fees are deducted automatically from each transaction.

6. Prohibited Items

You agree to list only original artwork or authorised reproductions for which you hold all necessary rights. You must not list counterfeit, stolen, or infringing works. Art+Ist reserves the right to remove any listing and suspend any account that violates these terms.

7. Account Suspension

Art+Ist reserves the right to suspend or terminate an Artist's account, including disconnecting their Stripe account, in the event of repeated disputes, fraudulent activity, or breach of these terms.

8. Limitation of Liability

To the fullest extent permitted by law, Art+Ist shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform or from any transaction conducted through it. Art+Ist's total liability to you shall not exceed the platform fees paid by you in the three months preceding any claim.

9. Governing Law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

10. Instagram Integration

The Platform offers Artists the ability to connect their Instagram Business or Creator account and share their artwork directly to their Instagram feed. This feature is powered by the Meta (Facebook) Platform and the Instagram Graph API.

• You may only connect an Instagram account that you own or are authorised to manage.
• You are solely responsible for the content you publish to Instagram through the Platform, including ensuring it complies with Instagram's Community Guidelines and Terms of Use.
• The Platform will only publish content when you explicitly choose to share. We will not post on your behalf without your action.
• By connecting your Instagram account, you authorise the Platform to access your access token and basic profile information (username and profile picture) for the sole purpose of enabling artwork sharing.
• Art+Ist is not responsible for any actions Meta or Instagram may take regarding your account, including content removal, reach restrictions, or account suspension, as a result of content shared through the Platform.
• You may disconnect your Instagram account at any time, which removes the Platform's access to your account.

11. Changes to These Terms

Art+Ist may update these terms from time to time. Continued use of the Platform's payment features after notice of changes constitutes acceptance of the updated terms.
